Abstract

English private international law contains rules which deny courts jurisdiction over certain claims because of their subject matter. A fundamental question arises as to the relationship between these rules and the jurisdictional scheme created by the Judgments Regulation. This article reflects on that relationship and the extent to which the Regulation’s scheme can adequately address the concerns which animate these rules through careful restriction of its material scope.
